              A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF LAKELAND, FLORIDA RELATING TO PUBLIC RIGHT-OF-WAY; MAKING FINDINGS; DECLARING THE CITY COMMISSION’S INTENTION TO ADOPT AN ORDINANCE VACATING A PUBLIC ALLEYWAY LOCATED AT 309 E. ORANGE STREET; PROVIDING FOR SEVERABILITY; PROVIDING AN EFFECTIVE DATE.

 

              WHEREAS, the City of Lakeland, as property owner, seeks to vacate a 10-foot-wide public alleyway located at 309 E. Orange Street, south of E. Orange Street, north of E. Lime Street, east of S. Kentucky Avenue and west of S. Massachusetts Avenue, within the City of Lakeland, Florida; and

              WHEREAS, the City Commission finds that the above-described alleyway is located beneath an existing structure, is not currently utilized by the public for passage or otherwise, and there is no reasonably foreseeable need to utilize said alleyway for passage or other public purpose; and

              WHEREAS, the City Commission finds that it will further the public health, safety and welfare of the citizens of the City of Lakeland for said public right-of-way to be vacated;

              NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF LAKELAND, FLORIDA:

              SECTION 1.  The foregoing findings are true and correct and are hereby adopted and made a part hereof.

              SECTION 2.  The City Commission hereby declares its intention to adopt an ordinance discontinuing, closing, vacating and canceling that certain 10-foot-wide public alleyway located at 309 E. Orange Street, south of E. Orange Street, north of E. Lime Street, east of S. Kentucky Avenue and west of S. Massachusetts Avenue, as more specifically described and graphically shown on Exhibit “A,” attached hereto and incorporated herein by reference.

              SECTION 3.  Owners of real property abutting the right-of-way intended to be vacated have been notified of this intention and any persons having any objections to the vacation of this right-of-way may be heard during the meeting of the City Commission of the City of Lakeland beginning at 9:00 a.m. on the 20th day of October 2025, at Lakeland City Hall, City Commission Room, 228 S. Massachusetts Avenue, Lakeland, Florida, when the ordinance vacating the right-of-way will be considered.

              SECTION 4. This Resolution shall take effect immediately upon its passage.

              PASSED AND CERTIFIED AS TO PASSAGE this 6th day of October A.D. 2025.
