Notice of Intent to Adopt a Development Agreement


Notice is hereby given that the City Commission of Lakeland, Florida, proposes to approve the following:

CONSIDERATION OF ADOPTION OF A DEVELOPMENT AGREEMENT BETWEEN THE CITY OF LAKELAND AND IPS ENTERPRISES, INC., THE DEVELOPER, FOR PROPERTIES LOCATED GENERALLY EAST OF INTERSTATE DRIVE, NORTH OF STATE ROAD 539 (KATHLEEN ROAD); GRANTING VESTING RELATING TO THE PROJECT’S TRANSPORTATION IMPACTS, REQUIRING VARIOUS ON- AND OFF-SITE TRANSPORTATION MITIGATION MEASURES.

The subject properties on 12.61 acres are generally legally described as:

AN AREA OF LAND IN THE NORTHEAST QUARTER OF SECTION 11 TOWNSHIP 28 SOUTH RANGE 23 EAST, POLK COUNTY, FLORIDA, FURTHER DESCRIBED AS THAT AREA OF SUBDIVISION LAKELAND INTERSTATE BUSINESS PARK EAST OF INTERSTATE DR, LESS PARCEL 232802020501000012.

The properties that are subject to the Development Agreement form a charter school with grades kindergarten through eighth grade known as IDEA Public Schools and consists of the following:

  1. Maximum enrollment of 425 students in Phase I, which opened in Fall 2024;
  2. Maximum enrollment of 1,645 students at buildout of Phase II;
  3. School will operate within existing building, with potential future gymnasium to be added in future with maximum parapet height of 35 feet.

The first public hearing on the proposed Development Agreement, pursuant to Section 163.3225, Florida Statutes, will be held on Monday, November 4, 2024 in the City Commission Chambers, City Hall, 228 S. Massachusetts Avenue, Lakeland, Florida. The City Commission meeting will begin at 9:00 a.m. and the public hearing will be held shortly after the meeting is called to order. Interested persons may inspect such proposed Development Agreement at the City Attorney’s Office or Community & Economic Development Department in City Hall and may appear and be heard at the meeting with respect to the proposed action. A second public hearing is expected to be conducted at the November 18, 2024 City Commission Meeting.

Anyone deciding to appeal a decision by the Board on any matter considered at this or any subsequent meeting will need a record of the proceedings, and for purposes of that appeal, may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.
